Introduction

These Terms of Use describe the conditions under which the OTVerdict website and assessment services are provided. By accessing this website or engaging with the OTVerdict assessment process, you acknowledge and accept these terms. These terms are effective from March 2026.

Service Description

OTVerdict provides independent operational technology cybersecurity defensibility assessment services. Assessments evaluate OT security posture against NIS2 Articles (EU 2022/2555) and ENISA Technical Implementation Guidance (EU 2024/2690) based on evidence submitted by the client. All assessments are delivered as written reports.

No Certification or Compliance Guarantee

The OTVerdict assessment is an independent advisory review. It does not provide certification, regulatory approval, or a guarantee of compliance with any law, regulation, or cybersecurity framework. NIS2 compliance is self-attested — the assessment provides documented evidence that reasonable steps were taken. Organisations remain solely responsible for their own operational security and regulatory obligations.

Scope of Engagement

Each engagement is scoped to the specific sites, domains, and systems agreed at the scoping call. Any expansion of scope beyond what was agreed requires a separate engagement and separate invoice. The assessment report applies only to the environment described in the submitted evidence and does not cover systems, sites, or domains outside the agreed scope.

Client Responsibilities

Organisations engaging with the OTVerdict assessment process are responsible for: (a) ensuring that all information and evidence submitted is accurate, current, and representative of the operational environment being assessed; (b) not submitting credentials, passwords, or other sensitive authentication data; and (c) ensuring they have the authority to share submitted materials with OTVerdict for the purposes of the assessment.

Payment Terms

50% of the agreed engagement fee is invoiced on confirmation of engagement and is due before assessment work begins. The remaining 50% is invoiced on delivery of the final report. All invoices are payable within 14 days of issue. Work will not commence until the upfront invoice is settled. Fees are non-refundable once evidence review has begun.

Delivery

Reports are delivered within 10 working days of completed evidence submission. The delivery clock starts when OTVerdict confirms that all required evidence has been received in full. Delays in evidence submission will delay report delivery accordingly.

Assessment Reports

Reports produced as part of the OTVerdict assessment process represent an expert opinion based on the evidence and information submitted. Reports are intended for advisory and internal decision-making purposes. The client owns their report and submitted evidence. OTVerdict retains the right to reference the engagement for internal methodology development purposes, subject to confidentiality obligations.

Confidentiality

OTVerdict will not reference clients by name in marketing, testimonials, or public materials without explicit written consent. All engagement details are treated as confidential. Clients agree to treat the OTVerdict methodology, framework, and report structure as confidential and not to reproduce or distribute these materials.

Intellectual Property

All methodologies, frameworks, scoring models, and assessment materials produced by or used by OTVerdict remain the intellectual property of OTVerdict. The client owns their own assessment report and submitted evidence. No part of the OTVerdict framework may be reproduced, licensed, or used commercially without written permission.

Limitation of Liability

OTVerdict's total liability in respect of any engagement is limited to the value of the engagement fee paid. OTVerdict is not liable for operational decisions made by clients based on assessment findings, for incidents occurring after the assessment, or for any indirect, consequential, or business losses arising from the service. The assessment reflects the state of evidence at the time of submission.

Website Use

Use of this website must be lawful and must not interfere with its operation or security. OTVerdict reserves the right to restrict access to the website at any time.

Governing Law

These Terms of Use are governed by the laws of England and Wales. Any disputes arising from these terms or from the OTVerdict assessment service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to These Terms

OTVerdict may update these Terms of Use from time to time. The current version will always be published on this page. Continued use of the website or services following updates indicates acceptance of the revised terms.
